How to File

File your small claims case at the Superior Court of California, County of Lassen, Hall of Justice, 2610 Riverside Drive, Susanville, CA 96130 — the county's single small-claims courthouse. Bring a completed Claim of Plaintiff (SC-100) and pay the filing fee (or file a fee-waiver request, form FW-001); the court's website does not reference a separate small-claims e-filing portal, so plan to file in person or by mail. Individuals may claim up to $12,500; businesses are limited to $6,250, and no more than two claims over $2,500 may be filed per calendar year.

Serving the Defendant

Serve the defendant with the Claim of Plaintiff and Order to Go to Small Claims Court at least 15 days before the hearing if served within California, or 20 days if served outside California, by personal service, substituted service, or certified mail. File proof of service with the court before the hearing date.

California Civil Code § 1950.5 requires landlords to return your deposit or provide an itemized statement within 21 days of move-out. If they fail to do so, you may be entitled to your deposit back plus up to 2× the deposit amount in statutory damages.
