How to File

File your small claims case with the Yuba County Superior Court, 215 Fifth Street, Suite 200, Marysville, CA 95901 -- the court's only location, which handles all divisions including small claims. Bring a completed Judicial Council form SC-100 (Plaintiff's Claim and Order to Go to Small Claims Court) plus the filing fee, which depends on how much you're seeking and how many claims you've filed that calendar year; if you can't afford it, file form FW-001 to request a fee waiver. You may consult a lawyer beforehand, but you cannot have one represent you at the hearing itself -- you must present your own case.

Serving the Defendant

The plaintiff (or a defendant filing a Defendant's Claim) is responsible for having the claim served on the other party -- you cannot serve your own claim. Service must be made by someone at least 18 years old who is not a party to the case. Under California law, service must be completed at least 15 days before the hearing if the other party lives in Yuba County, or 20 days if they live elsewhere. The completed proof of service (with an original signature) must then be filed with the court at least five days before the hearing date, and a separate proof of service is required for each person or business served.

Know Your Rights Under California Law

California Civil Code § 1950.5 requires landlords to return your deposit or provide an itemized statement within 21 days of move-out. If they fail to do so, you may be entitled to your deposit back plus up to 2× the deposit amount in statutory damages.
