How to File

File your completed Plaintiff's Claim and Order to Go to Small Claims Court (SC-100), plus one copy for each defendant, with the Clerk's Office at 500 Argonaut Lane, Jackson, CA 95642. The Clerk's Office is open to the public Monday through Friday, 8:00am to 3:00pm, and can be reached by phone at (209) 257-2603 from 9:00am to 3:00pm. If you cannot afford the filing fee, ask the clerk about a fee waiver (form FW-001).

Serving the Defendant

The defendant must be served with the claim at least 15 days before the hearing if they live in Amador County, or 20 days if they live outside the county. Service can be made by certified mail arranged through the court clerk, or by personal or substituted service through the Amador County Sheriff's Office, a private process server, or any adult who is not the plaintiff. A completed Proof of Service (SC-104) must be filed with the court before trial if the clerk did not handle service.

California Civil Code § 1950.5 requires landlords to return your deposit or provide an itemized statement within 21 days of move-out. If they fail to do so, you may be entitled to your deposit back plus up to 2× the deposit amount in statutory damages.
