How to File
File your small claims case at the Trinity County Superior Court, 11 Court Street, Weaverville, CA 96093. Bring a completed Plaintiff's Claim and Order to Go to Small Claims Court (Form SC-100) along with the filing fee, or a Request to Waive Court Fees (Form FW-001) if you cannot afford it. The court's small claims packet lists related forms -- such as the Proof of Service (SC-104) and Other Plaintiffs or Defendants (SC-100A) -- available on the court's website.
Serving the Defendant
After filing, you must have the other party formally served with your claim at least 15 days before the hearing (or 20 days if they live outside the county), using personal service, substituted service, or certified mail as allowed under California law. File the Proof of Service (Form SC-104) with the court before your hearing date.

Hearing Tips
- The court does not provide interpreters for small claims or civil cases; you must arrange and pay for your own interpreter in advance of the hearing.
- Remote (Zoom) appearance for small claims and civil matters is available only upon an approved request using Judicial Council Forms RA-010 and RA-015 — it is not automatic.

Know Your Rights Under California Law
California Civil Code § 1950.5 requires landlords to return your deposit or provide an itemized statement within 21 days of move-out. If they fail to do so, you may be entitled to your deposit back plus up to 2× the deposit amount in statutory damages.
