How to File
Small claims are filed at the Hall of Justice (400 County Center, Redwood City). Office visits are by appointment only — schedule before going. Hearings may be held at the Redwood City Hall of Justice or the Northern Branch in South San Francisco — check your notice for the assigned location. Small claims appeals (SC-140) must be filed under 'New Case Filings,' not the existing case number.
Serving the Defendant
Serve the defendant at least 15 days before the hearing (20 days if the defendant lives outside San Mateo County). Service can be made by the San Mateo County Sheriff for a fee, by a registered process server, or by any adult who is not a party. File the proof of service (SC-104) with the court before the hearing.

Deadline: Serve at least 15 days before the hearing date.
Hearing Tips
- In-person appearance is the default — Zoom appearances are only granted for hardship; submit the hardship protocol form in advance.
- Small Claims Advisor appointments open each Tuesday morning — book early for help preparing your case.
- The court runs a small claims mediation program over Zoom that can resolve cases before the hearing.
- Bring three copies of every document and arrive at least 15 minutes early.

Know Your Rights Under California Law
California Civil Code § 1950.5 requires landlords to return your deposit or provide an itemized statement within 21 days of move-out. If they fail to do so, you may be entitled to your deposit back plus up to 2× the deposit amount in statutory damages.
